In Illinois, a driver is considered legally impaired if their blood alcohol concentration (BAC) is greater than .08. While a driver is not obligated to submit to such testing if asked, it is important that every driver understands the significant and dissimilar consequences for refusing and failing breath or other chemical testing. Conversely, an individual’s driving privileges will be summarily suspended for at least one year, if that person refuses to submit to breath or chemical testing.

In addition to the loss of driving privileges, a DUI is at minimum a Class A misdemeanor, which is punishable by up to 364 days in jail and a fine of $2,500.00. If aggravating factors are present at the time of arrest (e.g.: the lack of a valid driver’s license; a 3rd or subsequent DUI offense; an accident causing death or bodily harm) a driver can and will be charged with a felony, which may entail a sentence of one year or more in prison.
